Thank you for reading these General Terms and Conditions of Sale (GTCS) carefully before placing your order on the website www.jerem.com. Access to and use of the website, as well as any order placed, are subject to acceptance of these GTCS.
These General Terms and Conditions of Sale (the “GTCS”) apply, without restriction or reservation, to all sales concluded by TOO FASHION SAS with non-professional buyers TOO FASHION SAS on the website www.jerem.com. TOO FASHION SAS operates the brands JEREM and TOO FASHION and sells men's ready-to-wear products.
The Products offered for sale on the website are as follows:
Suits, Jackets, Trousers, Parkas and Casual Jackets, Shirts, Jumpers, Coats, Leather, Jeans and 5-pocket trousers, Ties, Socks, Boxers, Belts, T-shirts, Polo shirts, Bracelets, Braces, Gloves, Shoes, Bow ties
The main characteristics of the Products, in particular the specifications, material and patterns, and the size or colour indications of the Products, are presented on the website www.jerem.com, which the customer is required to read before ordering.
The choice and purchase of a Product are the sole responsibility of the Customer.
Product offers are valid while stocks last, as specified when the order is placed.
These GTCS are accessible at any time on the website www.jerem.com and shall prevail over any other document.
The Customer declares that they have read these GTCS and accepted them by ticking the box provided for this purpose before starting the online ordering procedure on the website www.jerem.com.
Unless proven otherwise, the data recorded in TOO FASHION's computer system constitute proof of all transactions concluded with the Customer.

The Products presented on the website www.jerem.com are offered for sale in the following territories:
France, Germany, Belgium, the Netherlands, Luxembourg, Italy, Spain, Austria, Ireland, Portugal, and other EU countries.
ARTICLE 2 - PRICES & CONDITIONS OF VALIDITY
Product prices are displayed in euros, inclusive of all taxes (incl. VAT), excluding delivery charges. The applicable prices are those in force at the time the order is confirmed.
Orders are accepted in the following countries: France, Germany, Belgium, the Netherlands, Luxembourg, Italy, Spain, Austria, Ireland, Portugal, and other EU countries.
The prices of the products sold on the online shop www.jerem.com are indicated per item and reference and are inclusive of all taxes (incl. VAT). Prices are always exclusive of delivery charges; the customer is informed of the amount of the delivery charges when placing the order.
Products for sale are invoiced on the basis of the prices in force at the time the customer confirms the order. The price indicated when the order is placed and confirmed by the JEREM online shop is the final price.
The JEREM online shop reserves the right to change its prices at any time.
When ordering, Customers are asked to ensure that the price of the Products they refer to matches the price shown on the up-to-date page of the online shop www.jerem.com and not on an outdated page they may have accessed through an internet search in so-called “cache” mode.
The data provided by the customer and recorded by the online shop www.jerem.com when ordering constitute proof of the transactions between the JEREM online shop and the customer. After the customer has confirmed the order, the JEREM online shop will send the customer a confirmation email notifying them that the order has been recorded.
The price of the Products purchased is payable in cash, in full on the day the Customer places the order. The JEREM online shop shall not be obliged to deliver the Products ordered by the Customer if the price has not been paid to it in full beforehand (including delivery charges). Ownership of the Products is transferred to the Customer only after full payment of the price by the Customer. The transfer of the risks of loss of and damage to the Products shall take place upon delivery and receipt of the Products
by the Customer.
Delivery charges are indicated on the online shop www.jerem.com and are expressed inclusive of all charges. These charges are payable by the Customer and are invoiced in addition to the sale price of the Products. The Customer will be informed of the delivery charges relating to their order before the order is finally recorded, and payment will be requested from the Customer for the total amount of the purchase.
The products on sale on the online shop www.jerem.com are available while stocks last. Should the item or items ordered become unavailable after the order has been placed, JEREM customer service will inform the customer by email or by post. The order will be automatically cancelled and the customer refunded immediately.
ARTICLE 3 – Orders
It is the Customer's responsibility to select on the website www.jerem.com the Products they wish to order, as follows:
1/ Browsing and Selecting Products
The customer can browse the online catalogue and select the items of their choice. Before adding a product to their basket, they must select the available variants (size, colour or any other option offered). A detailed product page is available for each item to help with selection.
2/ Confirming the Basket
Once the products have been added to the basket, the customer can view a summary of their selection. They can change quantities, adjust the chosen variants, remove items or continue shopping before moving on to the next step.
3/Logging In or Creating an Account
If the customer already has an account, they can log in with their credentials.
If they are a new customer, they must enter their personal information and create an account or order as a guest. The customer must accept the General Terms and Conditions of Sale before completing their purchase.
4/ Entering Delivery Information
The customer enters the delivery address and, where applicable, any specific instructions.
5/ Choosing the Delivery Method
Various delivery options are offered depending on the geographical area and the desired lead times. Delivery charges are specified at this stage.
6/ Selecting the Payment Method
The customer chooses from the accepted payment methods (bank card or PayPal).
7/ Checking and Confirming the Order
Before final confirmation, an order summary is displayed with details of the items (including the selected variants), the total price, any additional charges and the delivery address.
8/ Secure Payment
Payment is made via a secure platform. A transaction confirmation is displayed once payment has been approved.
9/ Order Confirmation
A confirmation email is sent to the customer summarising the order details, including the chosen variants, the tracking number (if applicable) and customer service contact details.
10/ Dispatch and Tracking
Once the order has been dispatched, the customer receives a notification with a tracking link to follow the delivery in real time.
11/ Receipt and Right of Withdrawal
On receipt of the parcel, the customer must check its condition and report any anomaly to customer service. They have a statutory period in which to exercise their right of withdrawal, in accordance with the legal provisions in force.
Product offers are valid as long as they are visible on the website, while stocks last.
The sale shall only be considered valid after full payment of the price. It is the Customer's responsibility to check that the order is accurate and to report any error immediately.
Any order placed on the website www.jerem.com constitutes the formation of a distance contract between the Customer and the Seller.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning payment for a previous order.
The Customer can track the progress of their order on the website.
ARTICLE 4 - SECURE PAYMENT
Payment is due immediately upon ordering by bank card (Visa, Mastercard), PayPal or other methods indicated on the website.
The debit is made when payment is confirmed. The website uses a secure payment system via World Line, guaranteeing the protection of banking data.
In accordance with the provisions of article L 132-2 of the French Monetary and Financial Code, a commitment to pay given by means of a payment card is irrevocable. By providing their bank card number and the aforementioned information, the customer authorises TOO FASHION to debit their credit card for the total amount of their order including VAT (delivery charges included).
The customer's bank card is debited when payment for the order is confirmed.
To this end, the customer confirms the name of the holder of the bank card to be debited, then provides, in a secure environment, the sixteen-digit number and the expiry date shown on the front of their bank card, as well as, where applicable, the visual cryptogram numbers shown on the back of their bank card.
TOO FASHION reserves the right to check the personal data provided by the customer and to take any measures it deems necessary (request for supporting documents and/or cancellation of the order) to verify that the person whose bank account is debited is indeed the person who placed the order, and thus prevent any fraudulent use of bank card numbers on its Online Shop.
The products ordered remain the property of TOO FASHION until the invoice has been paid in full.
Worldline alone, through its secure area, has knowledge of the customer's banking information. This information is never transmitted via the JEREM online shop www.jerem.com.
ARTICLE 5 - SHIPPING & DELIVERY
Orders are dispatched within 2 to 5 working days by Colissimo. Delivery charges and lead times are indicated when the order is placed.
The customer must check the condition of the parcel on receipt and notify the carrier of any anomaly on the day of delivery.
When entering their order, the customer is shown on the online shop the choice of delivery method and location as well as the corresponding price. The customer can choose to have their order delivered to their home (or to their office, to a third party or to their holiday address) by Colissimo, or to a Mondial Relay pick-up point. In all cases, the delivery address must be located in Metropolitan France (including Corsica), Germany, Belgium, the Netherlands, Luxembourg, Italy, Spain, Austria, Portugal, Bulgaria, Cyprus, Estonia, Finland, Greece, Hungary, Latvia, Lithuania, Malta, Poland, the Czech Republic, Romania, Slovakia, Slovenia, Sweden.
The order is delivered by La Poste via Colissimo or to a Mondial Relay pick-up point, to the delivery address entered by the customer, within 2 to 5 working days.
When a parcel leaves TOO FASHION's warehouses to be delivered to the address given by the customer when ordering, the customer receives electronically from the online shop www.jerem.com a shipping confirmation stating the tracking number of their parcel.
For delivery by Colissimo, the parcel is handed over against signature. If the recipient of the parcel is absent, a collection notice is left.
With their collection notice, the customer can then collect their parcel from the Post Office, bringing proof of identity, within 15 days of the date on which the notice was left. After this period, the parcel will be returned to TOO FASHION. JEREM Customer Service will then contact the customer regarding a possible re-dispatch of the order.
If, within 5 working days of the parcel being dispatched, the customer has had no news of their order, they must contact the Post Office nearest to the delivery address or Mondial Relay. If neither the Post Office nor the delivery tracking system offered on the Colissimo or Mondial Relay website has any record of the parcel, the customer must then contact TOO FASHION through JEREM Customer Service, which will then open an investigation with La Poste or Mondial Relay. TOO FASHION is then bound by the carriers' response times:
- If the parcel is found, it is sent to the customer: the receipt procedure then follows its normal course (delivery of the parcel or collection notice).
- If the parcel is declared lost, TOO FASHION then informs the customer and immediately initiates a refund for the parcel (products and shipping costs).
The following are considered in particular as cases of force majeure releasing TOO FASHION from its obligation to deliver: war, riot, fire, flood, strikes, accidents, inability to obtain supplies.
It is the customer's responsibility to check shipments on arrival and to refuse the parcel if necessary, if it may have been opened or if it shows obvious signs of damage. If the customer accepts the parcel and finds that the goods have been damaged, they must send their complaint by registered letter with acknowledgement of receipt to TOO FASHION within 3 working days, excluding public holidays, following delivery of the products.
As this is an online sale, no complaint of any kind can be handled in store.
In accordance with the French Consumer Code, TOO FASHION grants the customer a withdrawal period. This is fourteen clear days from delivery to reverse the purchase decision and return the item(s) ordered. (see RETURNS tab)
ARTICLE 6 - RIGHT OF WITHDRAWAL & RETURNS POLICY
6.1 Exercising the right of withdrawal
In accordance with article L. 221-18 of the French Consumer Code, the customer has 14 days from receipt to exercise their right of withdrawal, without having to give reasons or pay penalties. When the period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

Upon receipt of the letter, TOO FASHION will send a prepaid return label by email.
TOO FASHION is required to refund the consumer all sums paid for the items subject to the withdrawal, including the corresponding delivery charges, without undue delay and at the latest within fourteen days of the date on which the company receives the returned items. Items must be returned in their original packaging, with the original labels still attached, complete (accessories included), new, unworn, unwashed and accompanied by the completed withdrawal form.
In the event of partial withdrawal from an order that benefited from a promotional offer linked to a quantity of items (discount or gift), the items kept by the customer will be invoiced on the basis of their original price, without promotion, in accordance with article 6.2.

6.2 Returns policy (outside the statutory right of withdrawal, beyond 14 days or without a formal withdrawal request)
Products must be returned accompanied by the "Return Form" in their original packaging, unworn, with the original labels still attached, unwashed and complete (accessories included), within 30 days of the order confirmation. Return costs are borne by the customer, except in the event of an error on our part.

In the event of an error on our part, a prepaid return label will be sent to the customer by email as soon as the error is reported, within 14 days of receipt of the order. Products must be returned in their original packaging, unworn, unwashed and complete (accessories included).
In all other cases, the costs of returning items are borne by the customer.
When returning one or more ordered products, the JEREM online shop recommends that its customers take out a parcel tracking option to avoid any inconvenience in the event of loss or theft of the products during return transport.
Items must be returned in their original packaging, complete, new, unworn, unwashed and accompanied by the return form. The return form can be downloaded from the "My Account" area. Items returned without a return form and/or that do not meet the listed conditions or that have been spoiled, damaged, deteriorated or soiled by the customer will not be refunded.
In the event of a partial return or non-return of products that were the subject of a global promotional offer including one or more gifts, the gifts granted by the JEREM online shop in connection with the purchase of one or more Products must be returned to the JEREM online shop. If the customer keeps the free Product(s) given as part of the global promotional offer, they will be deducted from their refund on the basis of their original price.
In the event of a partial return of Products that were the subject of a global promotional offer including discounts, the products kept by the customer will be invoiced on the basis of their original price, without promotion.
If Products are returned after the above-mentioned period, the customer will not be refunded and will be informed that the products remain at their disposal at the warehouse for a period of 1 month. On request and at the customer's expense, the Products may also be sent back to them.
Please note: Products purchased on the JEREM online shop are not eligible for a credit note or an exchange by post.

6.3 Refunds
Refunds are made within 14 days of receipt of the returned products.
The customer has 30 days from the confirmation of their order to request a return (this period applies only to the returns policy in article 6.2; the statutory withdrawal period in article 6.1 remains set at 14 days from receipt).
ARTICLE 7- STATUTORY WARRANTY & LIABILITY
The products are covered by the statutory warranty of conformity (articles L. 217-3 to L. 217-20 of the French Consumer Code) and the warranty against hidden defects (articles 1641 to 1649 of the French Civil Code).
The company cannot be held liable in the event of force majeure or for indirect or consequential damage resulting from the use of the products.
Items sold on the online shop www.jerem.com are subject to the warranty conditions provided for by law.
In the event of non-conformity of an item, the customer may, at their choice and after returning the product under the conditions of article 6.2, be refunded for the item ordered within 14 days of their request being returned.
These provisions do not deprive the customer of their right of withdrawal provided for in article 6.1.
TOO FASHION cannot be held liable:
- in the event of failure to fulfil contractual obligations due to an unforeseeable event or force majeure.
- in the event of non-substantial differences between the photos, texts and illustrations of the items on the JEREM online shop and the items ordered.
ARTICLE 8 - PERSONAL DATA PROTECTION
The data collected are processed in compliance with the GDPR and our Privacy Policy.
The customer has a right of access, rectification and erasure, which they may exercise by contacting contact@jerem.com.
TOO FASHION maintains an electronic file listing certain personal data relating to its customers. When an order is placed on the online shop www.jerem.com by any new customer, this database is enriched with information about them, which will subsequently make it possible to better meet their expectations and facilitate the assistance services provided by JEREM Customer Service.
When creating or viewing their accounts online, customers agree to receive offers from TOO FASHION.
Should the customer agree to provide individual personal data, they would then have the individual right of access, withdrawal and rectification provided for by law and may, in this respect, have any information concerning them that is no longer relevant deleted, by sending a request by email to: contact@jerem.com.
By registering on our website, the customer agrees to receive our offers and newsletters. They may at any time ask to be removed from the mailing list by writing to us at the following email address: contact@jerem.com.
The online shop www.jerem.com uses “cookies”. A cookie is a computer file stored on the hard drive of the customer's computer to improve and personalise the service provided to them by TOO FASHION. The customer retains the option of refusing cookies by configuring their internet browser.
ARTICLE 9 - INTELLECTUAL PROPERTY
All content on the website (texts, images, logos, etc.) is the exclusive property of TOO FASHION. Any reproduction is strictly prohibited without prior authorisation.
ARTICLE 10 - DISPUTES & MEDIATION
In the event of a dispute, the customer may contact the Customer Service department. In accordance with articles L. 616-1 and R. 616-1 of the French Consumer Code, any unresolved dispute may be referred to a consumer mediator.
